Here's the senario...(father has custody of son)

Mother decides to take son to the orthodontist and is told 7-yr old son needs braces, father tells her not to have it done until insurance kicks in in 4 months. Mother then tells father that she will pay for the braces each month and takes son to have them put on, now 2 months later mother expects father to pay for braces, but since braces are now a pre-existing condition insurance won't take over...Who do you think should be stuck with the bill?

Mother should have to pay. Father WHO HAS CUSTODY asked her to wait. She didn't. Furthermore, she entered into a verbal contract (which is a binding contract) to pay. If the doctor bill is in her name, he can just ignore it - that's her credit. If it is in his name, I'd take her to court. Seems like he's got a good case.

The mother. All she had to do was wait 4 months for the kid to be covered under insurance, than most of it would of been covered. If the father doesn't want to deal with all the problems because of this, he can find out from the insurance company how much of the braces would of been covered, he can deduct that amount from what the braces cost, then split the remainder in half, because that's probably what he would of had to pay anyway. That sounds like a peaceful fair way to resolve the problem.
Example: braces cost mom $5,000
insurance would of covered $2,500,
that would leave $2,500 for the parents to pay,
Dad's & Mom's share would of been $1,250 each,
so Dad could send Mom a check for $1,250,
& Mom can be responsible for $3,750.

the mother because she went ahead and had them put on 4 months would not have been that big of a deal he is 7 not 17 so i think the mother should be stuck with the bill.

The mother because it was her decision to go ahead with the braces after the father, and custodial parent, asked her to wait.

mother because she is the one that wouldnt wait for the insurance to kick in

Im fifteen and i got braces when i was 13 and to get them i had to have all my baby teeth pulled to get them
i dont think a 7-year old needs them in life or death...she could of waited 4 more months for them

no one a 7 year old would not be given braces, and if they were you need a new orthodontist, you need all permanent teeth to receive braces, no 7 year old is ready, usually between 13-17

number 1 the kid shouldnt have braces in the first place he is 7!!! teeth straighten on their own most times and he dosent even half of his adult teeth yet. the mother it was her stupid decision.

the Mother, techinally, but..... depending on the father's financial situation, for the sake of the son, he might consider chipping in. Besides, insurance rarely comes close to paying anything near to what's billed, so even if the ins had kicked in, you likely would have plenty of co-pays, right? And surely you would have contributed to the co-pays, so...... pay what you would have been responsible for, even with ins.
