I bought a new car a few weeks ago and someone rear ended me last week. I am now going to be without my new car for at least 21/2 weeks. I have been provided with a rental car, but, the rental car that they gave me is a "intermediate" model. It's a chevy cobalt - which I have nothing against but it has no power options it is a 2005 and has over 40,000 miles on it. It has a faint odor and stains all over the interior. I'm not sure if I should just put up with it for a few weeks and be glad that I have it to get to/from work. I really am upset at being inconvienienced like this. The rental car is actually embarassing. It has dents all over the outside too. I have talked to the insurance co. They told me to ask for a different car and the rental co. told me that they can give me the same car I have but a year older. That one is probably in worse condition. Shouldn't the insurance co of the guy who hit me try & make this as inconvienient as possible for me?

By law insurance company are supposed to supply a rental veh that is similar to the size veh you own that was damaged, and if im not mistaken also the same condition. But I know for sure at least same size veh. They will try to get you in a smaller one, but they have to go with a veh that is similar make model, and size.. Doesnt matter if your the insured, or clmt..

1) Who picked out the rental company? If the car is unsuitable, go get another one from another company.

2) Are you talking to YOUR insurance company or THEIRS. Their insurance company will try to keep the costs down. Yours shouldn't care since the accident was not your fault.

3) If you don't get some immediate resolution, try this

a) Get a written estimate from the repair company for how much longer the repair will take. See if they have an association with a rental company to provide discounted rentals.
b) Get a quote from another rental company for a car for that period plus a day or so (just in case). The quote should be for a comparable car.. not a deluxe something.
c) Notify the other person ( with a cc to his insurance company) that the car that was provided was unsuitable and possibly unsafe and that you are going to rent a car for this amount from this specific company. Give him 24 hours to respond (fax the letter).
d) After the 24 hours return the rental you have and rent the one you priced out. You will have to front the costs, but simply do not sign off on any settlement until the matter is resolved.

Remember.. the key word here is fair. You are entitled to be made whole.. not to take advantage of the situation, and if can not reach a settlement and you end up going to court the judge will look to see that you acted fairly and responsibly.

You should call the insurance company and ask to speak to the claims adjuster. Let him or her know your situation and ask to be put with a different car rental company or at least a different location than the one you're dealing with. It sounds like this rental place is pretty shady. Most rental companies get rid of their cars well before 40,000 miles. Good luck!

It's hard to beleive that that car is in that bad of shape. Rental places usually keep their cars very clean. I would call them and demand that you get another car. It's not like they aren't getting paid for the car. Go up there and tell them you want another car and you wont leave until they give you another one.
Oh and where did you get this car so that I can be sure never to use them.

There really isnt much that you can do but talk to the rental place. I lol @ the cobalt being "intermediate" Its a compact!.Go see if the other one is any better and choose between the two.

Many times you can pay for an upgrade, if you're unhappy with your vehicle. You will need to pay the extra difference, but it's usually 2 or 3 dollars extra a day for a much better car.

Otherwise, I'm afraid your stuck with your stinky cobalt.

Maybe his insurance wont cover for a better, nicer rental vehicle. It should only be temporary right..? Just remeber this experience for future reference. For the bad smell i recomend getting a air freshner.
