Its his first offence he was in a mental hospital at the time and he was drunk, the charges say he pushed staff member against wall and scratched on body, he pushed another staff member onto a water dispenser and he bent back fingers of another staff member. I take it he will receive a fine he only makes #200 a week what do you think will happen to him??

He was in there because he was suicidal and suffering from depression he tried to take his life a few times

They will take into account his pay when fixing a fine...

Also what were the circumstances of the case? Was this just a once off event and has he promised to change his behaviour...

Why should he go to prison and WHY is it disgusting for assaulting three health care professionals in a mental health hospital? This is common practise sadly and we do not know the facts behind this and why he is there for a start! Putting this man into custody would be yet another travesty of justice what we are seeing all too often here. He SHOULD get a community service order however, custody seems to be the only thing that can be managed properly these days when I don't feel this would help your friend or the community on his release at all!

Depending on his history this all will be taken into account and I hope his case is treated fairly and it comes to a satisfactory conclusion for everyone.

He has been charged with an offence. You do not say what the charge is.

He accepts that he is guilty and is willing to plead guilty. He should however have legal representation.

If the offence carries a possible custodial sentence then the
court may not accept his guilty plea without a solicitor who will explain his personal circumstances and attempt to mitigate on his behalf.

He might be guilty but the law does say that his interests still have to be protected

I can't get my head around the excuse... He was drunk at the time. Followed by a wimpy cry of ... He only earns £xxx.

If a person can afford to pay for liquor he can afford to pay the fine. As for using inebriation as an excuse for committing a crime there is a simple cure, stop drinking.
I like a drink as much as the next man, but can control myself after having it.
As for those poor souls who cry... "Little Johnny Wouldn't do a Thing Like That." Because they knew his dear old Mum are living in Cloud Cuckoo Land.

If it is his first offence, and he is pleading guilty early enough, the mitigating factors of his mental health should help keep him out of custody. I would give him a community order, where he would work off his punishment. Anything else would just make matters worse and would not deliver justice

seeing how he was in a mental ward of a hospital and intoxicated I would have to say he should plea not guilty. he can say at the time of the event he wasn't of sound mind and didn't know what he was doing. the fact he was in the mental ward of the hospital shows that he was diagnosis as dangerous to himself and others. Have him talk to a lawyer law change depending on the state.

its not that he wasnt in the right frame of mind so he cant plead insanity as he was only there for his own protection. suicide and depression generally dont make you a danger to the public. he probably wont be sent to jail tho, but probably a suspended sentance.

if he pleads guilty, then the charge will be relaxed a little, i think. and if he's sectioned under the mental health act, it may be taken into account.

lets hope he goes to jail we dont really need him out hurting others maybe its time for him to get slaped a some but its sounds like a small cage might be better choice
