The IRS will hold the money for six months to resolve any issues over the claim. The money will go to the local child support enforcement agency. If you have been getting public assistance the "state" will take their cut first. What ever is left you will get about a year after the offset was collected from your ex. Just in time to do it again.

Once the refund is offset by FMS it is held for 6 months to allow for a spouse to file for Injured Spouse relief. If no claim is filed in that timeframe it can be released through the child support enforcement agency for payment to you. The local child support enforcement agency handling your case can explain this and any local procedures to you.
