If some public servant demands bribe FIRST for some of his official work done & other person gives that without complaining for it.....
We know that public servant will be punished .. but what about the person who gave bribe on demand?
Q------Will some person who gives bribe on DEMAND of some public servant & don't complain about it ...also be punished?

Any person who gives bribe to a public servant will be considered abettor under section 12 of the Prevention of Corruption Act1988, which provides: - Whoever abets any offence punishable under Section 7 or Section 11 whether or not that offence is committed in consequence of that abetment, shall be punishable with imprisonment for a term which shall be not less than six months but which may extend to five years and shall also be liable to fine. Section 7 provides punishment for Public servant taking gratification other than legal remuneration in respect of an official act. & section 11 provides punishment for Public servant obtaining valuable thing, without consideration from person concerned in proceeding or business transacted by such public servant.
So in both such cases even giving of such a bribe is an offence as an abettor whether such complaint of bribe being complained or not.

It is called Bribery of a Public Official and it is a felony. The person that offered the bribe as well as the person receiving the bribe can be punished.

If caught there is surely a punishment for the bribe giver as a participant in crime.
Even if not caught this act encourages corruption to an extent that it becomes unbearable for the same person in future.
There are no limits when a malaise starts to sink in.

the person taking bribe can only be punished if the person giving the bribe has complained and that to he has to be caught red handed.so how is it possible that the person giving the bribe is arrested cauz nobody will launch a police camplaint against himself.

The person giving something to a public servant to do some of his official work is not committing a crime.
The person giving something to a public servant to do some illegal work is committing a crime.
If a person committing a crime is caught, it is likely to be punished.

Of course it is punishable! giving a bribe is as bad as taking one!! The giver is guilty of what is known legally as abetment, which simply means, encouraging a crime!!
