In your case The Payment of Gratuity Act, 1972, provides Gratuity shall be payable to an employee on the termination of his employment after he has rendered continuous service for not less than five years, continuous service here means for any period of one year he shall be deemed to be in continuous service under the employer he has actually worked under the employer for not less than two hundred and forty days this period includes period which may be interrupted on account of sickness, accident, leave, absence from duty without leave (not being absence in respect of which an order treating the absence as break in service has been passed in accordance with the standing order, rules or regulations governing the employees of the establishment), lay off, strike or a lock-out or cessation of work not due to any fault of the employee. Now calculate accordingly if you are covered under this Act for the eligibility of gratuity or not.

Mostly the policy is that you have to work at least for 5 years in same company to be eligible for gratuity. If you will leave this job before 5 years, it seems difficult to me that you have any chances. But right now you are not eligible for gratuity.

An Employee continue service 5 yrs he is entitle for Gratuity.

I'm not sure what you are asking. Are you leaving the company and want to know if you are entitled to severance pay? That will be different depending on your country, province/state, contract.

In Ontario, generally you are entitled only to a severance package once you have worked at the same company for a minimum of 5 years.
