i have told many childen that they can not ride their heally (shoes) in the dept store I been told to mind my own bussi ness, I was thinking about the the senior s who may fall and get hurt if struck down

I see kids with them [the shoes with the built in rollers] in all kinds of stores. I think they are a hazard, and because children are presumed not to be negligent until they reach a certain age, they are not responsible for injuries they cause.

It is important for stores to take appropriate loss prevention measures, and, quite frankly, I do not think it is fair if a store gets sued for personal injuries of a customer who is contributorily negligent or in a situation where one customer (like a child) causes injuries to another customer.

If someone is injured in your store, then they have the option to explore whether you had any role or liability in the incident.

Unfortunately, if other stores in your mall, shopping center, or even in your area, have considered banning these shoes from being used, then the right lawyer could use that to attempt to prove that you should have known of the danger and took no action.

You questioning this yourself indicates that a lawyer could ask a question and you would have to commit perjury to answer that you had never been aware or had considered these shoes to be potentially dangerous.

If you own or manage the store, you have the right to refuse service to anyone "rolling" into or around your store. Tell them that you are minding your own business and can do without theirs. If you don't own, be sure to discuss this with the owner/manager before launching out on your own crusade without proper backing.

Yes you can be sued if one kid rolls over someone, or even if one of those kids fall themsellves. The store is responsible for any risky situation they allow on their premises.

The store has all the right to forbid the entry of any one wearing those shoes (remember the store is private property), but you must post visible signs forbiding warning about it. You can even have the cops to escort out anyone who doesn't want to follow the rule.
