ok when i was younger (like 8 or 9) i obviosly didnt know what sex and stuff like that was. and my older step brother (he was somewhere between the ages of 10-11) knew what it was and watched porn and stuff... anyways we did stuff, like kiss, and we took a shower together and slept naked together and may have played with eachothers parts in sexual ways.(i dont remember if we did or not) i thought it was like a game or something. but he was older and knew about that stuff. he should have known better.... but i dont know. i think it was my fault. i never said to stop. please help. and im really confused. because to be sexual abuse dont i have to say "stop"? and i didnt soooo.. i dont know. im telling my therapist tommorow i told her i my step brother abused me and i didnt know whether it was abuse or not. but i havent told her what he did. and she said i could tell her next time, which is tomorrow. so is it abuse or not. please help!

It's called statutory rape.

You were below the age of consent. This means you were not young enough to understand the situation, and therefore even if you gave consent (which you did) it does NOT matter in a court of law. The case will be tried as if you did not give consent.

Also, there is no "statute of limitations" on crimes such as abuse, rape and murder. In case you don't know, the statute of limitations is the time limit for you to report a crime. Therefore, you can report this crime any time in your life, and the law enforcement agency will act on it.
However, you may want to act as soon as possible, because if you wait too long, the Defense lawyers will try to convince the judge that you do not remember the events.

Its not legally sexual abuse because you were both too young...if he was 14 while you were 8 then it would be sexual abuse/battery. Most states statutes declare that the age difference between minors should be 4 or more years...otherwise if they are both close or the same age who do you charge?

Probably all children go through that sort of exploration. It is not sex abuse. Your brother was only a child himself. Now if an adult did those things with a child, it would be considered sex abuse under most laws.
