We have kept the mortgage current. We also would like her off the mortgage, any suggestions or know hows?

Her and my husband were never married and on the deed it appears "a single person" after each of their names.

Your husband made a grievous error in maintaining a joint property ownership after the relationship ended. You can only get her off the mortgage by refinancing the mortgage. As far as getting her off the tiele and deed, SHE has to agree with your offer as to how to go about doing so. She seems to have no real reason to sign off on the title and deed, since YOU are keeping her mortgage current.

If two people buy a house together, you cannot force one party to sell or buy-out, unless there was a contract signed between the two parties when you bought the house.
However, she can just stop paying the mortgage, and if you cannot fully pay the mortgage, it will damage both your credit and her credit.
When you buy a house with another person, you are saying that you are responsible for the entire mortgage payment, regardless of the financial status and decisions of the other party.

Sadly enough, she can force you to either buy her out or sell. It's a harsh reality of a break up.

If you have kept the mortgage current, perhaps you can talk to the mortgage company and simply purchase the house from her, not a refi, but a flat out purchase.

Depending on what is in the divorce decreee. . .

You will have to probably buy her out or make some type of pay off arrangement.

If you cant agree, you will need to sell the home and split the profits.

If you can't buy her out she can force you to sell. It happened to me.
