Can I take lagal action against my part time employer for making me empty my pockets and letting them look for a missing ipod?? I have a part time job as a valet; there was an ipod that was stolen. My employer has no idea who took it but picked 5 guys and I out of the 30 other valets to search us. They told us you six are all friends so we need to search you. The rest of the valets they just checked in order of there last name. .I just feel that the way that they picked us out of the groups was not right, and also no where when I got hired did it state that they could search me and there are not signs stating this either….what do you think?

I wasnt thinking about suing, i was just going to go talk to the human resource department

You can try to talk to a lawyer, but I don't think the damages would be enough to make them try to make a case. It would be kind of a frivolous case. Emptying your pockets are not really a violation of anything. I mean if something was stolen I would be glad to prove that I had nothing to do with it.

Well, it is a valet. Valet has a notorious reputation for missing items from a car. Sounds to me like the boss was just trying not get reported for haveing stuff come up missing on his shift. He could have gotten fired if was reported, I would have done the same to keep my job.

You need to get over it. Something was stolen, they searched you and a few others, no big deal. If it bugs you that much, get a different job.

maybe but that's pretty shallow.

If someone took your crap you would want it back.

If you didn't take it you should have voluntarily emptied your pockets. Sounds like you want to be paid for being inconvenienced

Quite frankly, yes they can ask you to empty your pockets. You don't have to do it. Because you complied with the request, you have no recourse.
