If it is on the bark...I would pressure wash it using a pressure washer that you can control the pressure with.
Maybe sand paper would work as well?
You didn't really state what kind of tree or where it was on the tree.
You might get more help...with more details.

The best thing to do is wait it out. Bark is shed eventually. Perhaps you could pick at the bark, but you don't want to pick so deeply you hurt the bark cambium right below...and let's not talk about the cambial layer even deeper in.
Now if this is a tree that doesn't develop a shaggy bark, I guess you could paint over the paint with a latex paint that matches the rest of the bark....you could even get creative and use a second color to match the bark pattern.
Don't use any petroleum base chemcial including paint. While you might be OK with a shaggy bark tree, on a thin bark tree you'll cause serious damage!

The best is to wait it out. The bark will remove itself over time, it may not look so great, but let it go. Whoever spray painted the tree should be spray painted themselves. Typically, trees that are spray painted are buy a city that are to come down for whatever reasons. DO NOT use a pressure washer on the tree!, you could do more harm than good.

you can peel the bark. It would start to get its dark bark color back in a year and then wait it out for the bark to completely grow back.. pealing bark doesn't harm the tree(that much)
