the complex where my friend has been living w/her son for a couple of years is forcing her to leave because her son is going out on his own and it will be just her can they legally do this

If she has been living with her son and the lease is in his name and there is no mention of her in the lease, then yes, they can ask her to leave.

The answer is, it depends. If only his name is on the lease, then yes they can. If both of their names are on the lease, then I would imagine not, though they could force her to sign a new lease with only her name on it. If only her name is on the lease, then no, it would break the contract. This all assumes that she can afford the apartment on her own.

Of course, she would have to go to court to get a court order forbidding them from evicting her, or taking other steps to remove her.

Keep in mind: The laws vary from state to state, and I am not a lawyer, so don't take what I've said as legal advice.

If there is a lease, no...if the lease is in her name. If it's in his name yes, they can tell her leave. If there is no lease, then they have to give her a 30 day eviction notice...month by month means that either party can leave (or make leave) as long as proper notice is given.
