i get hit by another car the officer taking the report agreed it was not my fault can?
i sue for damages

You can certainly take an action for damages but it Will not help with any action the police may take against you for you criminal acts.

What would normally happen in a case like this, is that your insurance company will go to the other driver's insurance company and have them pay for your vehicular damages.
If the other driver doesn't have insurance, then you have to sue them civilly.
