Our company is going to issuse a smoke free work place. Over half the employee's at the company smoke and are not infavor of this ban. Is there any information out there to help us stop the ban or slow it down? I need serious answers because this is a serious issuse. Even better would be websites. If there is anyone out there that has faced this issuse before and has had failure or sucsess in their results please let me know through IM, Email, or yahoo answers.

I live in Washington State where there is a strong law against smoking. Smoker's do not have...nor they deserve any rights. It is a choice...not a right. About 20% or more citizens actually smoke now. They are a minority, thankfully going down into decline. Smokers will continue to lose rights as the amount of smokers falls.

The only thing you could do is to leave the premises during a break to have a smoke, other than that they can make whatever rules they like. It does not sound as though they are providing a place where the smokers can go. You could suggest to them even the prisoners in gaol in this country are being given the choice if they wish a smoke free cell, and they will be allowed to continue to smoke as long is it is not in a public area, so I guess you will have less rights than prisoners..Good luck.

smoking is not a protective class hence you really have no rights as toward smoking in the work place, couple with the movement to ban smoking in public places by state governments means the tied is not on your side as such not much you can do, but maybe ask for a designated smoking area

the only time i have heard any one challenging was a company policy that forbid smoking of their employees at anytime even when off work at home, they sued and lost so does not look good for your side

I doubt there is any that can be done, BUT as a smoker (who is fine with smoking in designated areas and away from buildings) I protested the total ban at my workplace based on the issue that obesity is gaining speed on smoking at the number one cause of preventable health problems. So, if you wish to ban the butt then ban the fat butts! Ban all trans fats, junk food, high cholesterol, high sodium foods in the workplace and require anyone who is over the ideal BMI to loose weight or risk being fired for non-compliance.

Even here in Kentucky we have gone smoke free. In Lexington and Louisville you can no longer smoke in government buildings or any bar or restaurant.Actually I think It's a good idea, No one should have to be subjected to smoke if they are not smoker. And by the way I am a smoker.

this is not an answer to your question, just an observation on the other postings to this question. This gentleman asked for serious info--websites etc where he could go to get information about fighting an issue he cares about. He got a bunch of smart *** cracks about how smokers don't have rights...how he should move to Kentucky and how he can't fight city hall.

People if you don't have anything to contribute shut up

There is nothing that will slow it down or stop it. Are they going to provide a place outdoors to smoke instead or is it going to a smoke free campus as many are doing? I have a friend and he took his business to a smoke free campus and only lost two employees. I thought that was sad that the cigarette meant more to them than their livelihood.

YOu need to start with the American Cancer Society. They can get you a copy of the current state law (they do vary by state). Look it over; there may not be a legal thing you can do at the local level if it's state law; in which case, try your congressman.

In australia we have this ban, but people still smoke, but out side the building on lunch breaks or coffee breaks. in ireland it is the same when i was there.
