I know that we can do trial by written declaration for a CA speeding ticket. I really want to fight this because I was caught going 65 in a 55 zone, which I think is quite reasonable. Additionally, the ticket and the local KY DA office does not know if I need the ticket will be report to the CA DMV. So, is traffic school needed for out-of-state tickets?

Contact the circuit court clerk listed on the ticket, not the county attorney, with your questions. Depending on the law enforcement officer who wrote the ticket (state trooper or local police) will be a big factor in your ability took get the ticket reduced. Ky does have traffic school, but I don't know if it is available for out of state residents. If you have a CDL, it will be reported to Ca DMV as required by Federal DOT regulations and traffic school will not be an option. Whatever you do, DO NOT tell a member of the court (clerk, judge, county attorney) that 65 in a 55 is reasonable, they will not be as easy to work with!

If your case is going to be that you feel that driving 65 was reasonable and the 55 limit wasn't, just pay the fine and save yourself some time. The Clerk of Court at the court in KY can tell you if you can plead by affadavit or not. If not, you'll have to appear in person or hire a KY attorney to defend you.

If you want to make it go away, get a KY attorney and see if he or she can plead it down to an offense without points. It usually costs less in the long run that way when insurance rates are taken into consideration.

Any points assessed in KY will stay in KY, however your home state may assess points on their own if and when they get wind of the conviction. The KY DA may not know if conviction information is shared with CA, but a KY DMV office should.

Your insurance rates are another issue entirely. That will be up to your insurance company.

If you want to go the traffic school route to get it dismissed, you'll have to attend it in KY. That assumes that KY offers that option.

Most jurisdictions will allow an out-of-state motorist to plead not guilty by affadavit. Go online to the DMV website of the state that you got the ticket in and look under the contact section, or simply write to the DMV and state that you wish to plead not guilty by affadavit.

Whatever points are acumulated in 1 state stay in that state, if you do want to take a defensive driving class or traffic school (as some states call it) you'd have to do it in the state that you got the ticket (not your home state).

Or if you don't frequent Kentucky that much, then after a period of time the infraction would be lifted on its own.

Respond to the ticket according to the info on it. The dmv record is automated and bound to show up in CA. Call CA dmv about driving school.

just call the clerk of the court and get it knocked down. youll still have to pay a fine, but no points.

boston....you dont need an attorney,
it can be done without one.....
