There is no federal tax id number unless you are planning to hire people. You use your state one.

But you would have to get current on your filing. If you were owed refunds, the penalties might not be too bad. You might even get some back. In my case, it was 8 years worth, and I got some of the refunds back.

First of all, you don't need a Federal tax ID# because you should have a Social Security Number. If you don't have a Social Security Number, then you have to ask the IRS for a Taxpayer Identification Number and use that as your Socail Security Number for filing taxes.

Second, do you own a business of any kind? If you do, then you need to ask for a FEIN.

As for penalties, you will only be charged penalties if you owe any taxes. If you are due a refund, then there are no penalties.

Also, the statute of limitations for claiming refunds is only 3 years while the statute of limitations for assessing tax for not filing tax returns is unlimited.

Oh my what a mess! Yes there are penalties. They will expand beyond belief depending on your income, the amount of taxes you haven't paid, and the timeframe. I suggest you talk with a tax attorney first regarding a settlement with the IRS. Otherwise, IRS could take you to the laundry. Not only that, but tax evasion can mean federal jail time. It may not be an issue in your case. Also, some states require that you pay state taxes. So a double whammy for disobeying their laws. You can use your social security number as a federal tax ID for a business.

It depends on if you owe taxes or if you are owed a refund. No, the IRS will not give you an FEIN until your back taxes are filed. If you owe taxes there will be penalities. You need to contact at minimum a CPA and a best a tax attorney to straighten out your situation. When you apply for a Federal Employer Identification Number a social security number will have to be put on the application.
