If you become very ill while working (severe heart condition), and use up your sick days and vacation. And can't work any more. Are all your benefits with the company then over. i.e. health insurance, life insurance etc ? Also, he has long term disability, but can't even apply for that until 90 days after he is first disabled.

1) Does the employer have over 50 employees? If so, the employer is subject to the Family Medical Leave Act (FMLA). The act provides for a total 12 work weeks in any one 12 month period.

(1) COVERAGE.--Except as provided in paragraph (2), during any period that an eligible employee takes leave under section 102, the employer shall maintain coverage under any "group health plan" (as defined in section 5000(b)(1) of the Internal Revenue Code of 1986) for the duration of such leave at the level and under the conditions coverage would have been provided if the employee had continued in employment continuously for the duration of such leave.

In order to be eligible, the employee must file for protection under FMLA

It depends on the company. If the long term disability is through the company, they might continue benefits. If it's a private policy, the company might or might not keep the person on, just on an inactive status, but still make benefits available, possibly at a cost to the employee.

If the company doesn't continue benefits, COBRA laws will allow the employee to continue medical benefits for a period of time, but the employee would have to pay the cost.

Once you are no longer employed by the company, they stop paying for your health, life, and disabiltiy coverage. Most of the time, YOU can continue paying for it yourself - through Cobra or Conversion plans.

Yes, long term disabiltiy usually has a 90 or 120 day wait.
