It was agreed upon both sides when my last day of work was. I told unemployment I was laid off and my company said I was fired thus getting a letter that stated my filing for unemployment is under review. How do I correct this and will I be denied. I was never written up for poor performence as my employer stated that the reason of termination nor did I received a 30-60-90 day review of my job. Also did not abuse or neglect anything or anyone. Do I agree that I was fired saying I misspoke, fight my side, or say that I was unsure what happened thus the reason why I picked what I did. i aslo filed the claim before the last day of pay but was told this would not cause a problem

Don't say that you were fired!!!!!!
Your company is saying this because they are trying to avoid paying you unemployment. If they can convince unemployment that they had to fire you because you were not performing your job or whatever else, then you will not receive unemployment benefits.
If you were layed off like you say you were then you would qualify for benefits because being layed off is basically that the company no longer had work for you so they had to let you go. Being fired is more because you were doing something wrong, not following company policies, etc.
It could be very interesting to hear what they say their reason is for firing you.
Just stick to what you told them when you filed. If you start changing your story around then they will definitely deny your claim.

Your claim is under review because you and the company told two different stories.

If you were fired because you weren't able to do the job, you'd most likely still gt benefits if you worked there long enough to be eligible. If the poor performance is something like not showing up for work, or being late a lot, then you probably wouldn't.

If you quit voluntarily, you would not be eligible. If you were laid off, you would be. If you were fired, it depends on WHY you were fired. Generally unless it's some kind of misconduct, you are still eligible.

Filing the claim before the last day of pay would not be a problem. The start date for benefits would be adjusted based on that.

There is no requirement for the company to give you a 30-60-90 day review, or any review, although it's good practice. Especially if you are not meeting job requirements, it would be reasonable for them to let you know that and give you a chance to improve, although they aren't required to.

You're a teef! You can file for UI benefits, but if your employer decides to appeal they can disclose the reason you were fired. It is not a good cause and so your Unemployment insurance benefits will probably be denied. If your employer decides not to appeal then maybe you can get the benefits. It also does not matter that your employer did not file a report for theft. They just don't want to incur additional costs for prosecuting you. As far as disclosing this to other employers - on the record, they can tell them that you are not eligible for re-hire which will make any potential new employer suspicious off the record they can say anything they want. WOULD SAY YOU WERE LAID OFF THEN YOU WILL GET BENEFITS IF YOU AGREE THAT YOU WERE FIRED YOU WON'T YOU CAN GO TO THE LABOR BOARD AND FIGHT IT GO IN FRONT OF THE UNEMPLOYMENT JUDGE AND PROVE YOUR CASE HAVE WITTINESS AND IF YOU CAN PROVE YOUR CASE YOU WILL GET UNEMPLOYMENT YOU SHOULD HAVE WAITED TIL THE LAST DAY THEN FILE WHY DID YOU APPLY BEFORE YOUR JOB ENDED THAT DOESN'T MAKE SENSE TO MY ACT FAST YOU HAVE LESS THAN 30 DAYS TO PROVE YOUR CASE OR NO MORE YOU CAN ASK FOR R A HEARING ASAP I WOULD DO THAT IF I WERE YOU GOOD LUCK

If the company says you are fired then you will not receive any benefits.
