nope as long as it is soda and not beer. One time I had a saranac Root beer, and if you see the bottle they come in it looks like any ole beer bottle, and the officer saw me drinking it outside and thought it was a beer because I had torn off the label, which is something I do quite often. I told him that it was root beer and not actual beer I let him look and even smell it and then he said ok it is root beer and let me go on my merry way.

dont think it would be illegal to drink the soda out of the beer can but if you cause trouble by doing so such as you are seen drinking it and are pulled over you might get a ticket for taking up there time. and for being an idiot.. seriously unles you just want to be a pain y would you do this anyway? and now that i think of it you could get charged for open flask anyway because i am pretty sure that if you have an empty beer can in your car no matter how or when it got there you can get charged.

That would be foolish. However, as long as the beer can was rinsed of the beer, meaning no alcohol would mix with the soda, you would not be doing an illegal activity. However, by a minor holding a beer can would give probable cause for the police to investigate. You'd be in a hassle over it for sure.

It's a waste of time to PUT soda into a beer can. If you did, you would probably have to prove to the authorities that the can did not contain alcohol. In a vehicle, and open beer can is illegal even with nothing in it. Short answer: Who cares. Its not worth the hassle.

A more to the point question is:

Is it illegal for a 15-yr-old to take an empty beer can, rinse it out, fill it with Dr Pepper, and drink it in front of a cop? If the cop thinks it is beer, is that enough to write the kid a ticket for underage drinking?

Along similar lines, if I hold a block of wood up to my ear while driving and a cop pulls me over for driving while talking on a cell phone, can I get the case thrown out? Is it illegal to drive while holding a block of wood up against your ear?

Interesting question. I would assume so because I do know that while driving, if you have an open alcohol container, such as a Jack Daniels bottle or wine bottle that has been refilled with water or soda, you can still be charged with driving with an open container.

I guess a person can use whatever they want as a Beverage Glass/Container. BUT, the beer can would give a police officer probable cause to see what going on!

I don't think it's illegal in itself. But the hassle of the search and probably the field sobriety test might piss the cop off enough to FIND something illegal
