I am a 50 yr old female who is diabetic. Just a few days ago I went to the emergency room cause of a pain I had in my groin. When the doctor came in to give me my results from the tests I took(urine, blood CAT scan) he told me everything was fine and I had nothing to worry about and it might be a muscle strain.He asked me do you know that you were born with one kidney? I said no. My mom didn't even know this. My husband mentioned maybe I should sue the hospital where I was born or other doctors since I have been x- rayed alot over the years. He said cause I have one kidney, I might get jaundice. Is this enough for a law suit? And are the statutes of limitations still valid?

Jaundice is caused by liver or gallbladder dysfunction, not lack of a kidney, and it's a disease symptom, not a disease itself. The doctors you've seen throughout your life do the best they can with the time they have, the knowledge they've earned, and the tools they're provided. There was no breach in the standard of care (the doctors didn't do something they weren't supposed to do), no negligence (the docs didn't not do something they were supposed to), and you have no damages (no problems as a result of your missing kidney). Doctors don't run kids through some whole-body scanner when they're pulled out of the womb, and it's beyond me why you would think the GP who X-rayed your broken arm when you were 9 is at fault for not finding your missing kidney.

The only reason the ER doc found it is he was specifically looking for pelvic problems and ordered an abdominal CT. Were you to find an attorney desperate enough to take your case, likely the only thing you'd get out of it is a pile of legal fees and maybe a spot in Leno's monologue -- you know, the part of it where he talks about the latest moron looking for a handout through some frivolous lawsuit.

It's really hard to sue hospitals and doctors. They would not have known to check you when you were born to see if you only had one kidney or anything like that. Now if you have had problems with your kidneys someone failed to tell you or find you only had one and it actually caused life threatening problems then maybe you would have a leg to stand on with a suit.

First off, if you`re 50 years old, do you really wanna sue 70-80-90 year old doctors? The hospital would never give you money. They would give you a formal apology and signal you to go away.

If you did try to sue them, be sure no one in your family knows about this. Orelse it`s invalid. THEN, if no one knows, i advise you to get a pretty damn good lawyer. You`re bringing the country to court after all.

Sue them for what? How would they know that you had only one kidney? What kind of x-rays did you have? Even on abdominal x-rays you can't always see the kidneys.

I think maybe you could sue your parents, since their really the ones who gave you just one kidney. Or maybe sue God?

I think it wouldnt be valid, since it was a long time ago and you where born that way.
