I have had the same waitering job for three years and I picked up a second job about 6 months ago and was fired for stealing. When I apply for other jobs, and I put that I'm working at the place I have been at for three years on the application, will an employer be able to tell that I got fired from the second job if I don't put it on the application?

Can employers tell if you got fired?
I have had the same waitering job for three years and I picked up a second job(retail) about 6 months ago and was fired for stealing. When I apply for other jobs, and I put that I'm working at the place I have been at for three years on the application and not the retail job, will an employer be able to tell that I got fired from the second job if I don't put it on the application?

If you don't tell them about it, chances are slim that they will find out. But when you start telling lies, it is easy to forget what you've said in the past and may let it slip or contradict yourself later. Then you can be fired for giving a false application.
Forget the advice that they can't legally say anything about why you were fired. They can say anything they want. But if they can't back it up 100% with proof, they open themselves up to lawsuits. For that reason many companies have policies that they will only give dates worked and job title. Some will tell if the former employee is rehirable. This is strictly company policy, not law.

Legally, all a previous employer can divulge about you is dates of employment, position, and whether or not you are eligible for re-hire. If you got fired, you may be sunk because you wouldn't be elegible for re-hire if you got fired. Roll the dice. The vast majority of employers fail to verify previous employment or even take the time to check references. P.S. Never write that you got fired on a resume or application. State you resigned.

If a prospective employer learns that you had a job you didn't list, especially recently, the question "why" will nag at them. They will call that employer and ask them why you left, and if they say "stealing", that coupled with the fact you didn't put it down makes it likely they will assume it is true.

it's hard for them to tell from the paperwork, but they will definitely call to verify your employment. this will usually just result in dates confirmed, but you never know. you probably want to test out your former employer by you or a friend call them up and pretend to be a prospective employer. ask for the dates of your employment, are you eligible for rehire, why did you leave, how was your performance, etc. if all they give are dates of employment, you're pretty much in the driver's seat. if they give negative information, well, at least you'll know for sure.
