HI, I am a resident of Mexico, My husband petitioned me to come back to the states legaly, but now he decided to leave me here wiht our daugther of 3 years old and not to bring me back, she is a US citizen.
I had to leave the country (voluntary departure) so that i could have a fair process, we've been separated for nearly 2 years.
How can I be at the divorce hearing if I cannot return to US???, is there a way I can be excused at the court, or is there any other way I can get a special "temporary " permit so that I could be there at the court.
I would appreciate all of your answers.!

Laura,thank you for trying to go about everything legally. If you don't show up in some manner you lose but you can appear by phone, I did in my divorce. Call the court and explain your situation and they will tell you to call the court a few minutes before trial. Call at the designated time and you are considered the same as being there. Good luck!

Some counties let you appear by phone. Call the clerk of courts in that county and advise them of your situation. Kudos on the voluntary departure. I hope you get your visa soon so you and your daughter can come back!

If you have access to Yahoo, then you have access to free email.
Start by emailing the people in the local court system that you are supposed to appear in, and ask them what the procedures are based on your situation.
I'm sure they will want you to be represented by a local attorney, which will cost $$$. Howevever, that attorney will also make sure you get alimony and child support from your ex.

If there is evidence of service via the sheriff then the listening to will proceed with out him and you gets regardless of you ask for. If there is not any evidence of service, the listening to would be postponed until service is useful. If the sheriff served him, then the sheriff filed a paper with the court docket testifying to service.

As far as I know, if you don't show up, you lose! I would definetly contact a lawyer or the court directly, in the state that your divorce hearing is scheduled!

I believe if you don't show up it can either be post-phone, or the case thrown out of court. I think it depends on the Judge. Good Luck.

Since you have acess to a computer, there are many immigrant advocacy groups who will take your case....Your situation is a complicated one and I am sure you can get help from non profit organizations.....Best of luck....

I would suggest contacting the court and explaining your curtimstances. You need to speak with them, simple not shoiwng up will look horriable on your part.
