My fiance and I adopted a kitten on Sunday from Petsmart. I was told the animals were brought over from a shelter for the day. We were told she was 8 weeks old and the contract states that. All this week we've been having problems with her. She's had diarrhea and for the past two days has not been active. Last night she stopped eating and she wouldn't take her formula, dry food, or wet food. I took her to the vet today and the doctor said she is only 4 weeks old! So she was a few days older than 3 weeks when we got her. Taking care of a 3-4 week old kitten is very different from one that is 6-7 weeks and just needs to put on a little weight. They can't determine what's wrong with her because she's too small for a blood sample. They're keeping her overnight and have been giving her fluids under her skin. I'm so angry that the agency would allow the kitten to be adopted and that they lied to me about her age!

I would call petsmart and tell them what is going on. any good shelter or pet shop should pay for the bills or take the cat back and replace it for you. good luck and i hope your kitty is feeling well soon.

p.s. did you vet check for intestinal parasites? like coxcida (spelling sorry)

The "agency", no doubt is a "not for profit shelter", because that is all the Pet's Smart will allow to display their animals up for adoption. What good would it do to demand that they pay the medical bills? They operate completely on donations. I am sure they did the best they could in providing you information. They will always take the animal back, but do you really want to return this little creatures you have started to nurture? If she is too much trouble, the over crowded shelter will have no choice but to put her down. Do not blame Petsmart. They try to help the homeless animals by allowing shelters to show their pets up for adoptions to perspective kind people who will provide forever homes for these animals. We all do the best we can for homelss animals. My vet would reduce the vet bill considerably if he knew the circumstances.

Be sure to tell PetSmart about this - they will have the option of not allowing that group back to the store.

Best recommendation I can think of is to tell the group and ask them to pay for the medical bills, and get a statement from your vet IN WRITING regarding the age of the kittens.

If you have a statement on the contract that she is 8 weeks old, then you have it in writing and you would have a legal basis for a suit, I would think. However, most rescue groups are non-profit and there's not much money there.

It sure sounds like they mislead -- or lied to -- you. I would complain to Petsmart and the shelter. Demand to have the vet bills paid -- but be aware that they might take the kitten back.

I hope the poor kitty will be OK. Good luck.

See how kitty does first, then sue them for breach of contract.
I would not take it back since God knows how it would end up.
The fact that they have breached the contract by lying in it makes the entire contract null and void, so whetever else is in there means nothing.

I would take the kitten back to pet smart. And demand them to take her back. Because that happen to my daughter also. Her kitten was to young & it died. Its symptons was just like what you explaned about your kitten. The kitten was not left with its mother long enough, so i would be afraid there would be problems later on.
