Here you go. Link to the information. Try not filing a tax return, or not paying your taxes, or filing a "frivalous tax return" or trying those old and tired tax protestor arguments, and see how fast you get the IRS's attention. Be prepared to pay fines and penalties in addition to the tax.

This is fairly simple.

An amendment to a law is an extension of that law (basically it takes the place of the law). Think of an amendment as a change, not a separate entity... If they changed the law of whether you can turn right on a red light.. that's the new law. Even though it was a change.

If they amend the constitution to show we have to report and claim all income in order to live in the united states as a citizen.. then I know I, for one, having seen what it's like in other countries am HAPPY to oblige.

Your question is amusing. I have been a tax accountant for 27 years. What causes you to think that an amendment is not a law? That aside, the answer is yes, the Internal Revenue Code contains several sections (laws!!!) requiring the filing of returns and payment of taxes by individuals and businesses. Anything you may have heard to the contrary is nothing more than "bar talk." The IRS has published an excellent summary (prepared by treasury department lawyers) of frivolous tax arguments, including citations of authorities and case law summaries as well. I suggest you download and read it before you land yourself in a heap of trouble.

Oh brother! Not again!

Yes, there is a LAW. It's called Title 26 of the United States Code. Here's a link: http://www.law.cornell.edu/uscode/26/usc_sup_01_26.html There are many more available, just Google "Title 26".

The basis for all laws flow from The Constitution. The Constitution specifically empowers Congress to levy taxes. The 16th Amendment to The Constituiton empowered Congress to levy Income Tax without apportionment, effectively treating it as an indirect tax. Prior to the 16th Amendment, the courts held that Income Taxes were direct taxes and therefore had to be apportioned among the several states. Apportionment of Income Taxes would have different tax burdens for each state, an impossible task to manage and hardly equitable.

(Contrary to generally held public opinion, Income Taxes were always legal. The 16th Amendment only removed the requirement for them to be apportioned.)

There is an amendment to the constitution. I realize that you said that you were not looking for an amendment, but a law. The fact is that the constitution is the primary law of the land and takes precedence over any other laws. Frankly, an amendment ot the constitution is a law.

... are you serious?

The information above regarding how and why they have the right to tax us and we are required to pay is correct. Go ahead and don't file or pay or both to try to "stick it to the government" or whatever. I'll see ya in a little while. We're always accepting new clients. The delinquent/non-filing business is an interesting one.

Haven't you ever heard the expression: All I have to do is die and pay taxes... and I don't even have to do that. True, you don't HAVE to, no one's going to stand over you and force you to send it in, but once the IRS finds out about it, you'll wish you had.

Would you rather pay taxes and be free and have rights, or live in a country where there are little to no taxes, because the government doesn't want to help their citizens, even if there was anything that could be done off the measly intake?! Geez. I'll file and pay mine well in advance of the deadline thank you very much. :-)

There is a law to report and file tax returns

Not this silly argument again.

By the way, and AMENDMENT is part of the CONSTITUTION, the basis for our country. And there are many specific laws built around it that specify details of taxation.

YES THERE IS. That is a COMPLETE answer to your question. You did not ask what the law is, and based on the history of this question, you don't care.

Of course all people who work, own their own business and are involved in anything that generates income, they are required to file tax returns. If they don't and get CAUGHT, it's called...TAX EVASION.
I think I would rather pay than go to jail for defrauding the government. Thanks. =)
