I suspect that my brother-in-law used my daughter's SSN to declare it as dependent in his last taxes preparation. What can i do?

What makes you think your BIL did this??

Was your return claiming your daughter rejected by the IRS? If it wasn't, nobody else claimed her.

Or did the IRS notify you that someone else claimed your daughter and is asking for proof? If so, just provide the proof that they asked for and you'll be OK.

The IRS will not discuss another taxpayer's return with you in any case. But if 2 taxpayers claimed the same dependent, they IRS will investigate the matter and award the exemption to the proper taxpayer and bill the other for increased taxes due, plus penalties and interest if appropriate.

Depending if you like your brother in law or not. You can report him to the Internal Revenue Service.

Did you file also, claiming her? If so, the IRS would catch it. If you think he did, and nobody else claimed her, they might not catch it. If she lived with them for over half of the year though, he could probably claim her legally.
