Yes, it is part of your state's consumer bill of rights. The insurance company has a right to send you to a shop for the appraisal, or send an appraiser out, HOWEVER, you have the right to take the estimate with you to your shop of choice. If your shop of choice has any differences with the estimate, then your shop will contact the insurance company (either yours or theirs, whoever you plan to go through will have the same procedure) and a supplement will be done, or the insurance company and your body shop of choice will negotiate price.

Of course you can take your vehicle where ever you'd like for repairs, but you can't insist the insurance company pay more than the lowest estimate just because you want a higher priced shop. You can accept what they offer, and pay the difference out of pocket. Sometimes if you use a shop they have recommended, they will stand behind the work done at the shop and make it right if there is a problem, which they will not do if you pick the shop.

Yes you always have the right to choose where your vehicle is repaired, even if the insurance company sends out an adjuster. The shop and insurance company will negotiate a fair price of repairs for the damages.

You have the right to have the car repaired at the shop of your choice. However, the insurance company that is paying will set the price.
I suggest that you pick your shop then take a copy of the insurance company estimate to the shop of your choice. Ask them to review the estimate and the car and determine if they can do the repairs at the insurance company figure.
If they can' they will call the insurance for you and talk to them about increasing the repair allowance.

You may choose your own repair shop but bear in mind that the at fault driver is only liable to pay the reasonable cost of repairs, which could be less than what your repairer has quoted.

to an extent yes you do..a lot will depend on if they have you get estimates or if they send an adjuster to settle the damage. if you are required to get estimates...normally they will ask you to get 3 estimates,,,then they will go with the cheapest. You can then a( use the cheapest estimate and repair shop. or b) Tell them you are going to have somone else to do the repairs and just send you a check and you will make up the difference. If they send an adjuster...it is wise to get at least a couple of estimates on your own though...and if they offer you more than the damages of the estimates...take the money and run...if they don't offer enough...tell them you have estimates and show it to them and ask for the most expensive one...better yet just show them the most expensive one and don't even tell them about the other ones.

absolutely. However, the insurance has the right to deny any unreasonable request that repair shop makes (such as replacing something that can be repaired or charging an unreasonable amount)

I'm not sure. I don't think so. The person-to-blame's insurance company usually chooses the place or sets a price for the repair of your car, but you can't exceed that limit. Kind of stinks, huh?
