Yes, but it is very difficult to do. You need some pit bulls of lawyers to pull it off successfully, and it can take years. You also had better be in the right, or you don't stand a chance.

Yes that is what started the exise tax refund that we all received this year. People were suing the government for wrongly taxing us and winning.
