Okay, a 750ml bottle is about 25.36 fluid oz. A fifth is based on a gallon measure, and is 4/5's of a quart or about 25.6 fluid oz. So no you can't plead the fifth because you're about .24 fluid ounces short.

You can plead the fifth or you can blame it on Jack, or you can plead the fifth amendment. I doubt it any of it will do you any good though. I'd bet the judge would get pissed off and you'll end up doing more time that you would have if you would have said something in your own defense. If it's serious I'd talk to an attorney if your facing a lot of jail time.
Otherwise take your chances. It's all a gamble when you drink like that, your odds get worse the more you drink.

If this is a serious question (i.e. 750ml. being a fifth vs taking the 5th amendment to avoid self incrimination under oath )and you have to drink to the point of blacking out, then not being able to remember what you did indicates your problems are far more than legal. Anyway, I doubt pleading the fifth will get you any sympathy from the court...actually it may make things worse for you. Get legal counsel.

just cuz you drank a fifth?
do you understand that you have to plead guilty or not guilty then in trail when you are asked a question you can plead the fifth to keep from incriminating yourself... whats the charge?

I would plead the 7th admendment because if you remember the 5th, then you might be caught legally.

You can plea the fifth even if you do remember something. Evidence is evidence though, so the fact that you don't have to testify against yourself doesn't help your case. Amnesia isn't a defence either, because it can't be proven.
