I live in MI but my employer is in NC. I'm about to get my wages garnished, can they garnish me even though my employer is in N.C? and I live in Michigan? Also the amount of the original bill was $125.00 a month but if I get garnished they can take up to 25% of my pay which equals $500/month, will they take $125 a month or $500 a month which is the max? I've already talked to an attoryney about bankruptcy to avoid all of this, but I was served a summons on April 2nd and want to know how much time I have before garnishment starts.

Yes, they can still garnish your pay even though your employer is out of state. And since the bill is obviously overdue for them to be garnishing your pay, the original $125 a month payment has no meaning any more, it's the total that you owe them, so they can take up to the max and probably will.

Going bankrupt might sound like a good short-term solution, but you'll live with the results for many years. If you can pay what you owe, you're much better off that way. And even if you file bankrupcy, if you're judged able to pay your debts they won't be discharged - it's not automatic.

There is a minimum percentage of your wages that you MUST get to take home. Depending on what you do for a living (i.e. my brothers run a construction company), you could be short hours one week, and have a low pay. For a bad week like that you might not have to pay the garnishment that week - but you still have to pay it. There is a possiblility you could petition the office that is garnishing your wages - domestic relations or the tax office, whoever - to get it reduced...BUT you could also end up having to pay more and be in a worse position than you are right now. If you owe lots & lots - chances are they'll take your tax refund, also - if you are entitled to one.

Judy is right on...... Go with it... BK is not automatic, and it not worth the hassle. If you had paid it in the beginning you would not be in this spot. SO........ MY suggestion is suck it up and let them take it to pay it off. If you had been paying the 125 then they would not have garnished it and so no they will take a full 25%. Sorry : (

Child support? If you're a MAN, the CSEA will garnish the maximum. If you're a WOMAN, you won't be held responsible. Bankrupcy, I don't think is an option. Certainly not for MEN. Even if you cannot pay, un-employed, ill, injured, etc, etc... CSEA or the court will demand without relent - thats IF you're a MAN of course. But if you're a WOMAN? You may receive much leniency, nor called a dead beat, nor jailed, or even expected to pay backpay on child support.

HINT: be sure to show up for your summons, yank a few tears, and mention victimhood... You're set (only applies for women).
