Here's the deal, my car has automatic seatbelts, but the shoulder strap doesn't move, and is always in the forward position. If I'm driving along and get pulled over, can I still get a ticket for not wearing my seatbelt if I have the waist belt on???

Yes. If not for the seatbelt violation itself, then for defective safety equipment because it doesn't work as it is supposed to.

Maybe both!

Yes, you can get a ticket. Law requires that a driver wear both a shoulder strap and lap belt. If for nothing else, you could get a ticket for defective equipment.
