You are now an EU citizen so you don't need any permission to remain in the UK. However, you need to tell us whether you worked here legally from 2003? i.e. were you on a work permit? under EU law you won't be able to apply for ILR until at least 2009, this is because Poland joined the EU on 1st May 2004. (Section 15 of 2006 EU Regulations). If you were here on a say 5 years work permit then the earliest you can apply for ILR is 2008 (you could only apply after 5 years). As previously stated you must hold ILR for at least 1 year before you are eligible to apply for BC. Also you must pass the 'Life in the UK test' and satisfy all the other requirements of the British Nationality Act 1981, Schedule 6. However, we need more info, such as where was your daughter born, are you married if so what is your husband's immigration status in the UK? etc.

You haven't said what status if any you have here at present. In general you can apply for the passport after five years residence, IF the last year has been with Indefinite Leave to Remain. It is three years residence if you are married to a UK citizen or someone with ILR.
If you are legally resident, but without ILR, you can apply after ten years, 14 years if you have been here illegally.

Perhaps you are an EU citizen, Polish for example? I'm not sure how it works exactly, but yes you probably can apply. But why bother? You have full rights already!

She needs to hold permanent status first before she can become a British citizen. The route for her would be as follows under EU law: WRS for 1 year (IF she is subject to registration and does not fall within the exemption), then application for a Registration Certificate and then after 5 years of having exercised a Treaty right, application for indefinite permission to remain under the 2006 Regs, then application for naturalisation and then passport. Under UK law, she would either have to get married to a British citizen and then apply after having resided in the UK for 3 years or she could apply under the 10 year rule if she's been in the country long enough. Whichever of the above is SOONER.

As far as I know you need to live and work for at least 5 yrs go in into your 6 th yr to apply for residency and a extra 2 more yrs for the passport.

well.... hmmm... What's you nationality? If you are illegal, the first step is (a hard one) making yourself known to the authorities. Just walk into a police station and say "me no passport". It works is swear! Then the process starts. Alternatively you may contact immigration or the home office. If your English is good and u work hard, you have nothing to fear.

After being in the UK for 5 years (legally) you should be able to apply for permanent resident status.
Once that has been granted you will further be able to apply for a Passport.

You are short on information.But sounds as though you are an illegal.I understand their is an amnesty on similar cases as yours.But you must relay these questions to the British Home Office in London.
