I am curious to know if when you talk to an insurance adjuster regarding your claim if they can / do record the phone calls. I know when you call them, the little messages states "this call may be recorded for quality assurance." But what about when they phone me? And also what is legal here and what can they use from the recordings?

Whenever ANYONE calls you...if the call is being recorded they must immediately disclose this to the person who answered the phone. If they are taking a recorded statement from you concerning your insurance policy or accident it is being used for investigative purposes (like the cops), and can be used, as evidence at trial.

If they record the conversation they must tell you that they are recording the conversation. Some states allow recording if only one party knows about it, but most require that both parties know about it. An insurance company is not going to risk recording a telephone conversation without covering their rear ends.

You did not say where you live. Laws vary from place to place.

Most U.S. jurisdictions permit recording those who call you, but you may not officially ( i.e., will likely not be available in court) record calls you make without the other party's assent.

Check with your local consumer information bureau for the rule where you live.

i will attempt to breakdown some information to you. 1st off once you filed this declare, maximum probably become to a shopper provider consultant or a decision center of filing new claims. maximum of those people do no longer take care of the claims, purely document them to be despatched to an adjuster who will actual take care of your declare. that's common that a declare will be transferred to different adjusters searching on the type of declare or in preserving with organization technique. Or some claims will be "chop up up" meaning quite a few adjusters will take care of; ie; vehicle coincidence; would have a adjuster for the damages, a million for medical expenditures, a million for legal duty and/or damage on your 1st declare for robbery, they chanced on out that a buddy become to blame and charged with the robbery, so completely official beloved you suggested. Now many years later, yet another robbery declare. yet this time various factors are unknown. Your coverage is for you, yet you probably did not notify them of your husband, who would were extra as a policyholder in case you had suggested them. I doubt that his citizen status would were a aspect, considering the fact that he become married to you and therefore would own stuff of his own; yet possibly i'm incorrect in this. He works on automobiles and has various equipment, and all of unexpected understand the equipment are lengthy gone after cleansing out the storage. You filed a police document that you're required to do in robbery, although the question is, who stole it? become it a buddy back or somebody else? you're claiming the lost of a device field and a compressor, yet you've the burden of information that he actual had this device field and compressor. You state that he offered his stuff from diverse elements and performance no receipts, that's fairly the real project, considering the fact that each and every time you purchase from maximum of those places, you have to be getting receipts, both by utilising written checks for the object, mastercard statements, digital mail affirmation of the acquisition and so on. you've filed a grievance with the coverage commissioner and by utilising regulation the coverage organization would ought to reply to this grievance. yet w/out receipts and information, they could deny your declare. sturdy success

Absolutely they can and do. Make sure you say the same things when they ask, and they will ask the same question in different ways.

Did you see my client's red Chevrolet? No.
When did you first see the other car? When it ran into me.
And what happened just before the accident? I saw a red car turn from the side street...

Bingo, there goes your credibility in court.
