Police officers observing violations of this law are permitted to stop drivers and take enforcement action.

The biggest problem, however, is the general publics refusal to write their community, state, and federal leaders DEMANDING more officers in the streets.

As an example, and my own agency is a mirror image of most departments, there are insufficient funds to:

1- hire enough officers for the existing population.
2- pay scale is so far below the average that there is no incentive to seek a law enforcement job.
3- so many lawsuits for "profiling" and other ludicrous issues prevent many officers from doing their sworn duty due to departmental restrictions in order to avoid frivolous complaints when they do their job!

Maybe a bit of pushing from the general public will get your state to hire more officers who can then get out and seek those who fail to properly restrain their children while driving instead of having to answer all those calls for immediate help because their spouse is brutalizing them, or because they're responding to a robbery, or because they're processing that drunk driver, or because for everytime they arrest someone for breaking the law...it takes three hours of paperwork so the lawyers won't complain!

Sounds like you are having issues with an ex and weekend visitation.

As long as the child is in a car seat there is no cause for the officer to stop the father. Also, the police can't just go into his vehicle without a warrant. I don't think a judge is going to issue a warrant to check a car seat.

There are no laws about a 2-year old sleeping in bed with their father either. Thank God, because when I get my kids they all want to sleep in my bed with me. I let all three of them but there have been times when just my 6 year old girl has curled up next to me. If anyone ever accused me of doing somthing wrong I would smash them for it. What do you want him to do, push his child away from him?

Just worry about being the best mother you can be and stop worrying about trying to accuse him of something wrong.

It is difficult because they do not have the time. However, most states, will offer car seat check clinics, and the Local PD should be able to tell you when and where.

If the child is in the front seat, the driver, could and should be ticketed.

I do not believe there is a law against that. As long as there is nothin inappropriate going on in the bed, it is not illegal.
