I am needing her tax returns for a school matter and she had back child support. So the state kept her taxes, which is why she did not pay H&R block. So i was wondering if they will still let her have a copy.

You can ask H&R Block, but don't be surprised if they say they've already given her her copy. And don't be surprised if they haven't even filed your mothers tax return yet, since they haven't been paid. Legally they don't have to give her a tax return if she has not paid them for their services. All they have to give her is her original information back.

This sounds as if she tried to get a bank product ( either a Refund Anticipation Loan {RAL} or Refund anticipation Check {RAC}.) With either of these products, the return is filed and the refund would be directly deposited to an account set up with a bank. With either the RAL or the RAC, or any electronically filed return, the Electronic Return Originator (ERO), H & R Block in this case, would know within a few days whether or not a return was accepted by the IRS. If it was accepted with no debt indicator, funds would be deposited to the bank, fees withheld and check printed or direct deposit to client. If it was accept with debt indicator, any past due taxes, child support or student loans would be taken first then the balance would be sent to bank as above. If there wasn't anything left, H & R Block and the bank would not have gotten their fees. the return was filed, but the client would still owe H & R Block their fee.

I believe there is a mechanisim in place for the off season offices to find out if rreturns have been paid for. Block will not give a copy of a return that is not paid for.

With RALs and RACs, the client would have received a copy of the return when it was completed.

Also: YOU could not get a copy of your mother's return anyway. She would have to get it herself.

Why would she not have paid H&R Block? It's not their fault that she owed back child support so didn't get her refund. If they prepared the return, they did THEIR job and should be paid.

If they didn't get paid, they're not likely to provide a copy of the returns.

You can get a copy of the federal return from the IRS eventually, and probably can get a copy of the state return, if you need it, from the state, but it might be a little early yet to be able to get them for the 2006 tax year.

If the return was filed but not funded by the IRS due to offsets The folks at Block would still have that in their system. If you ask for a copy they just may give it to you. When they pull it up in the computer it would take more work to determine that it was unfunded than to just print a copy. Particularly if you went to a different Block office.

If she never paid for the return, then the return that Block prepared belongs to them and not her. They do not have to (and should not) give her a copy.

Did H&R Block submit taxes for her? If they did, they likely took their fee out of her refund, so she has "paid" them and they should give her copy. Otherwise, contact IRS but that'll take a lot longer

contact irs and request a copy of hert tax returns for school, if she didnt pay them (i doubt they would file for her then) donesnt make sense.
