A close friend of mine is nineteen years of age and has a pregnant sixteen year old girlfriend. How probable is prosecution in such a matter?

Parents have no interest in prosuing charges.
In the State of Illinois.

Was she 15, when she got pregnant? If so the state can prosecute. Anything under 16 is the usual norm for the state stepping in.

It's quite possibly very unlikely if the parents are not prepared to press charges... I know I am in England and our laws are a little different but I knew a family here whom had three daughters all pregnant at the age of fourteen (legal age being sixteen) and because the parents did not mind or cause a fuss no charges were brought towards the older males whom had made these children pregnant at an early age, so I can only assume that your friend will experience the same... I should imagine he will simply be frawned apon but check the web sites for free information in your area for a more information. x

Because he is less than five years older than her, it's a misdemeanor under Illinois state law.

Bad break because a lot of states have gone to 16 as the age of consent.

No promises that he won't go to jail, but the courts will probably want him working to pay for the child, so it is likely he won't get any time.

Probably a fine... but lots of probation.

Being a vicarious liability crime, the state does not need parental involvement to pursue charges... although they may also decide not to press charges on their own.

It could happen, and has happened before. More over, it is a good chance that he will get found guilty by a jury who don't know their job as the Judge and the Prosecutor will tell the jury that "if they find that the male had sex with the female when he was eighteen or older, and she is not yet 18"

I am afraid that the only way to be sure not to is to get married before anything can happen. The prosecutor will find out from the doctor, so you better have your friend get married to her quickly.

this is not a joke.

the flip side is, in true christianity, they ARE married, just because they had sex. More over, your friend actually hurt the girl in many ways by just having sex.

In some states 16 is the age to concent to sex. Unless it is reported there is nothing anyone can do. If your friend goes to jail I am a bondsman, and it won't be too expensive to get him out, depending on what state you live in and how high the bail is. Just make sure your friend has all fines paid if any and no warrants for anything else.

Depends soley on how old she was when she got pregnant.
If she was fifteen then it is out of the parents hands and up to the state to pursue him, they could just say that they were not together at this time and then the state could not so anything, not advocating lying jsut putting various alternatives out there.

Chances are in parents of 16 year old do NOT press charges no jail.

depends on the current situation, and we don't know what that is!

Nice way to start a life!

It isn't up to the parents to pursue the issue, it is up to the police and prosecutor. I suspect they have plenty of medical evidence.

I doubt if he goes to jail, but then I don't live in Ilinois!

Parents have to press charges. She'd have to be young enough to get child services or whatever involved - like, 12.
