We claimed earned income tax credit and child tax credit. We have two children that are our biological children. They resideded with us their entire lives. We filed our taxes like we do every year but we got audited saying we had to prove our children resided with us for half of 2006. We provided information and not only did they deny the EITC they revoked the ctc and are asking for the money back. I had a chance to appeal and did, faxed in the information, even got a reciept saying they got the fax. I called today and they said they didnt get the documents and now my time is up.

Should I contact a lawyer now or wait till I get the 90 day letter of deficency???

P.S my children are 4 and 5 years old. I did tell the guy on the phone I had a fax confirmation receipt. He got quiet and said try back in a few days. Im sure I will get this 90 day letter because the last day was the 17th of may and its the 21st. This is creating a ton of stress on the entire family Im expecting our third child our home is to small and we need to move and cant until this is resolved.

Hi Raven - If I were you, I wouldn't wait for the 90 days to pass. It will take some time to find someone to represent you in this matter. A qualified accountant who specializes in tax problems may be the best way to begin. If you know someone who can recommend an accountant to you, that might be a start. If the accountant thinks that you need an attorney, he or she would tell you that. Be sure to find out if there will be any up-front fees. I would avoid any of the TV "one-size-fits-all" type tax firms.

How old are the children? If they're 17 or older, they aren't eligible for ctc any more, and if they're 19 or older, you can't use them to get eitc. Other than that, shouldn't be a problem.

When you called and they said they hadn't gotten the info, did you tell them that you had a receipt saying they got the fax? The IRS probably has millions of pieces of paper these days, so it's possible for something to get lost, but your receipt should help you.

Call the taxpayer advocate office at 877-777-4778.

Whoever gets in touch, tell them you want their superior's name so you can file a complaint. That you are being harassed. ~
And keep copies of everything!!!
