Last Thursday at my apartment complex, a kid drove his truck into my car. After the accident, i got out of the car and asked him for his insurance. I told him the damage was minor so i didnt want to file a police report but that i did want to call his insurance company. This was Thursday of last week. His insurance company is telling me to get an appraisal but they told me he has not answered their phone calls to claim responsibility. What can i do, if i dont have a police report? Is it still too late to file one? There were witnesses at the apartment that saw everything. The guy who hit me lives at the complex... Any ideas anyone?

But whats to stop him from saying that i hit him? I mean he did back into me, so there is no proof that he hit me... You know what i mean, he could tell the judge that i ran into him...

It's pretty simple. You have his insurance information- so there's no way he can get out of it.

IF he does indeed keep avoiding their phone calls then NO- do not call the cops! Instead what you need to do is take him to small claims court.

He will then be summoned to appear in court for hitting your car, and ignoring his insurance company. You do need to get an appraisal for the damage. Give your appraisal to the judge, the judge will find him at fault and tell him to pay up.

If he doesn't, he goes to jail. -But his insurance company WILL re-emburse you for your damage.

He can't hide forever! Hope this helps!

A lot of police agencies are not required to complete an accident report if the accident is on private property (i.e.parking lot). My department does this as a courtesy only. The form that we use is basically just an exchange of information. It is not necessary to call police to a private property accident. Call your insurance company also and advise them of the situation. Let the insurance companies decide which will pay for the damages. Since there is no accident on your record, then your premiums should not increase.

What did the insurance company tell you? You may need to file a report if the damage is over 1000 dollars. Call the police, and have someone come down and take the report. It only takes a few minutes and then you have it.

It is never too late to file a police report if a crime, no matter how small, was committed. The later it is, the less the cops can do about it (though if there are witnesses they can do a lot), but at the very least you'll get your police report.

In most states you have to file a police report within 48 to 72 hours or something like that. But you can try. Call your local police department, and see what they say.

Call or visit your local police agency and ask to file an accident report if possible.

Being on private property there is normally only a driver information exchange unless, in my state, there is a significantly high amount of damage.

File a police report...most insurance companies want one anyway, in Illinois if the damage was less than $500.00 it is not required to file a report...but file one now...protect yourself, also have the witnesses give depositions to the police......

Never too late to file a police report in most states. A police report is only required if someone gets injured. If not, then usually it's not necessary.

This guy sounds like he will not pay you which is not a rare occurrence. Definitely get the police involved before he leaves town.

Call the police department and ask if its too late to file a report. They'll be able to give you a better answer than anyone else on this forum.
