I don't know why I would take Nyquill and drive but what if i did.

The answer is yes, but you would have to drink a large quantity of Nyquil. The same holds true for anyone. Nyquil and all of those over-the-counter cold remedies contain some alcohol and some even go as far as to say that you shouldn't take their medication and operate a motor vehicle.

That's why DWI, means under the influence of alcohol or drugs. Even prescription medication can be used against you for DWI if the bottle has the warning stipulating don't operate a motor vehicle.

Uhhh, yeah. If not DWI then reckless driving. Nyquill makes you sleepy, actually any medication for that matter can make you sleepy. Muscle relaxers, pain meds, ect. But nyquill contains alcohol and if you drink too much and your blood alcohol level is above average to operate a macine of any kind you can be charged. It doesn't matter if you are a minor or not. You can still get charged, go to a teen court, and have your license taken away until you are of legal drinking age. You should call DMV to get the driving laws in your state.

In a word, Yes. There is enough alcohol in nyquil to give most people a blood alcohol level of over the legal limit. And besides, like you said, it's a night time medicine. You are supposed to go to bed when you take it. Bad idea all the way around to take it and drive.

If you are "drunk" it doesn't really matter what type of alcohol got you there. I don't think one dose of NyQuil could get you drunk, but it does also have medicine to make you tired. That's not a good idea. I believe that would be driving while impaired.

It warns you right on a Nyquil bottle not to operate machinery (a car is a machine) after taking Nyquil.

You were marked with DWI because technically you denied a breathalizer (when they asked for blood) to the law you are offering something called "Implied Consent" this means whenever operating a motor vehicle you voluntarily offer blood samples or other means of proving you are under the require alcohol limit. The lawyer, Witness Testimonies and other facts listed in your story prove obvious innocence, in court the judge is educated enough to understand your story. Let the lawyer do the talking and dont fret. No judge in their right mind would rule this incorrectly.

In my own state Code 32-5A-191(5) states:

"Under the influence of any substance which impairs the mental or physical faculties of such person to a degree which renders him or her incapable of safely driving."

Therefore, a dose of Nyquil in fact could result in the arrest for DUI/DWI.

Yes you could if you are in a zero tolerance state. I'm not so sure that you'd even be field tested unless a shot of nyquil makes you apprear intoxicated.

In Michigan it is Zero Tolerance. If you register nothing but .000, it is considered Minor In Consumption. If you register .08 then you are legally drunk (for the driving ofense). Either way it well affect your license and possibly even have it denied for several years.
