Sure you can, as stated earlier, seek legal action for anything these days. But instead of spending money on legal action, why don't you put some of that money to good use by offering to buy the newest drug to help your neighbour quit smoking, it's only $135.00 for a 30 day supply and then you would be helping yourself and your neighbour and at the same time you'd be saving some money. And for the love of God, please find something better to do with your time then sit around worried about what your neighbour is doing at his/her house and do something constructive with your life. There are more damaging health issues in this world besides your neighbour standing outside on his own property smoking a cigarette, why don't you do something about the pollution of the plants in your area causing cancer and lung issues?

1. Of course not. On what grounds could you possibly build a case? Legal action for someone smoking outside their own home would be a joke.
2. Try showing a little tolerance. People have the right to smoke on their own property.

Certainly, you can file a legal action.
The smoke coming in your house from your neighbor endangers your health and safety and annoys your senses. As such, it is called a nuisance.
The manner of filing the action is procedural and it depends on where you live. But as far as I knew, a demand must first be made upon the owner of the property to abate the nuisance. And if your neighbor understands, necessary legal actions could be avoided.

On whose property is he standing when he smokes ?
Why dont you write him a very courteous, polite letter appealling to him to direct his smoke elsewhere as you or your family are "allergic" to the smell, and it would not inconvenience him to direct his smoke elsewhere. Most decent people would respond positively.
If this doesnt work, and he is smoking on public property, he is effectively creating a "nuisance". You could complain to your housing Society, Municipality or Police but Im not sure what results you would get.
If worst comes to worst, wouldnt it be convenient if somehow, a bucket of water or garbage or anything else unpleasant, gets thrown on the offending smoker, from "somewhere" ?

* Other alternative - talk with your neighbour. There is a saying in Tamil which states that, For prostrating the witness, you can prostrate your opponent. So, talk your neighbour politely and then still if he does, take the society chief man for negotiations.

Put a powerful blower from where the smoke comes in.Switch it on as soon the smoke begins to enter your house.The powerful blast of the blower shall create a difficult situation for him and he has to accept it as he expect you to accept his cigarette smoke coming in to your house.Very shortly,ha may like to have a word with you.Wish you a happy ending to this episode.

I wish you could,because then I could sue everybody who drives a car down the street,or otherwise forces me to breather dangerous and toxic Greenhouse gases.Some of those polluters are so brazen about their toxic gases that they even drive to the courthouse to sue people who smoke in the wrong places.Imagine being so self opinionated that you think somebody else's cigarette is more dangerous than your car fumes,or the emissions from your power company that provides your electricity.Some people are so up themselves they never see their own share of fault.

He may do as he wishes on his own property. The only thing you could do is talk to him about it or close your windows. Better to leave it be.. you don't want to start problems up with your neighbor. If it is something illegal that he is smoking then yes you can report it to you local authority's.
