Two different issues.

If he has arrearages in child support, his refund can be captured for that.

If there is a tax debt from the marital estate, both of their refunds can be captured for that as well. I'm not sure which takes precedence, the child support or the tax debt.

If her back taxes was after they were ex, then no. If they were from when they were married, and they filed a joint return for the year or years the taxes are for, then yes they can.

And in either case, if he has support arrears, they'd be taken for that if not for back taxes.
