Technically, eating and driving, by itself, is not against the law but drivers can be charged with careless driving or not being in proper control of their vehicle. If you are charged for a motoring offence that indirectly involves eating whilst driving, and you choose to go to court to contest it, then the police officer who booked you will have to explain why, in his opinion, you were not in proper control of your vehicle.

Contrast this with using a mobile phone whilst driving. This has recently been made illegal in itself, so now a police officer does not need to say you weren't in full control of your car: just using the mobile is enough to book you.

Driving without due care and attention is an offence. While eating while driving could constitute this, it isn't specifically prohibited.

It would be down to the judgement of an individual police officer, whether eating was interfering with your ability to control the car.

The same could also apply to drinking, tuning the radio, lighting a cigarette, turning round to shout at the kids rioting in the back seat etc.

it depends in the state or county in which you live ..many places don't have laws or rules regarding what a driver can do while he or she is behind the wheel.
many states are changing that, so that a driver must have one hand on the wheel at all times and have nothing that distracts their attention away from the road.
but it is very difficult too change peoples habits and many people are fighting against such laws as it seems to limit what rights they have in their motor vehicles.the idea being that if a person has to get to from point "a" to point "b" that the world doesn't stop while they are on the road... people eating lunch on the go is a very common occurrence as well as cell phone use among business professionals.
many places are enacting rules of safety to discourage people from reckless driving habits, but some places don't have any laws in place yet!!
but whether or not it is a law , your son in law places him self a greater risk of injuring others and himself and others in his car by eating and not having full control of the car when an emergency situation occurs. even at 25 mph in a residential area can mean the difference between stopping in time or severely injuring or killing someone!!!

I read in the Daily Mail some time back that a woman was done for eating an apple whilst in control of a vehicle - she was in a traffic jam! But kill someone in a hit and run and get a couple of hundred quid fine!!! Says such a lot about this useless country.

It is a driving offence to eat whilst driving. It came into affect a few years ago.

It depends what you're eating, where you are, and the opinion of the officer who catches you. Burger on the M1 would be a problem, polo mint at the traffic lights should be ok. The actual offence would be not having proper control of the car.

all depends on what u are eating....... if u are eating a sweet, or something like that, it's fine....... if u are trying to eat a burger or something mad like that, then u could get prosecuted for it.

it's amazing how many people do eat whilst driving though.... the worst example i saw was a few years ago whilst i was waiting at a set of traffic lights.... the guy driving the car next to me was literally eating his breakfast.... he had a proper mug with tea / coffee in it, and a slice of toast !!! sometimes u really do have to wonder how muppets like that manage to get a drivers license !

Distracted Driving is against the law and eating while driving would leave you negligent in the case of an accident.
But aside from what the legalities are- how about itjust isn't a good idea? What happened to common sense and people who have the smarts enough to realize on their own what is a stupid thing to do and act accordingly?

It is an offence. You can be charged for not being in control of a motor vehicle. Mate of mine was booked for eating a sandwich while driving.
