About 12 years ago, New Jersey claimed the statue of liberty was in NJ's waterway therefore it was a part of NJ. Since technically the statue and liberty island is closer to the shores of NJ than NY, NJ sued to have the statue declared to be a part of NJ. Then NJ Gov. Christine Whitman, who later on was the head of the federal Environmental Protection Agenycy (EPA) tried to give the statue a NJ status but failed in court. The court deemed since the status has been associated with NYC for years and years, it was therefore a NYC landmark.

Traditionally when states or nations are separated by a river , it is the center-line of that river that is used to determine where one state ends and the other begins. This is why one often sees the "Welcome to" sign in the middle of a bridge.
The Statue of Liberty and Ellis Island are most certainly on the New Jersey side of the Hudson River's center -line .

Its in Jersey city, NJ. It is past the NY harbor zone that separates NY from NJ but NY has claim to it cause they maintained it for many years.

She was in NJ but the courts allowed NY to Annex Liberty Island. Reasoning was for years NYC offered the security and emergency services as well as everyone assumed she was in NY.
