I was driving enterprise rent a car.The third party hit me we filled a police report but it did not say who was at fault.Now both enterprise and the other party wanted me to pay for the damage?I did not have insurance at the time of accident,i was looking a purchase a car.I did pay for enterprise damage,but now they want me to pay for the third party too.Should i fight them and go to court.After all he hit me.
Any good advice will be appreciated.Thank you.

I noticed how you conveniently LEFT OUT the facts of the accident. If you're being asked to pay for the 3rd party damages, you were found to be at fault. And don't say, "he hit me." WHY were you hit. Cops don't determine negligence, insurance companies, judges, and juries do. Sucks for you you didn't buy the liability insurance from Enterprise. Pay up.

The problem seems to be that you were driving without some kind of insurance. So here you are without any coverage, naturally they will hold you responsible.
The guy did hit you, but that could have been your fault, if you pulled in front of him. Fault is in question, otherwise the police report would have clearly shown who was at fault by the diagram.
You need to get an attorney, because you were driving illegally in the first place when you got in the car with no insurance coverage.

If he hit you, his insurance should pay for all the damages to rental and his car. Pictures of the damage might support your case if you have any and a copy of the police report, even if there was no fault indicated. I would go to court.

I would go to court. If the third party hit you, they should be liable to the damage to their car and to the rental car. If it is determined that the third party was at fault, they (or their insurance company) should not only pay for the damage to their own car, but should also reimburse you for what you paid for damage to the rental car. However, if you were at fault, then you would be responsible for damages to all the vehicles involved.

i would consider a lawyer, if your certain the other car is at fault. sounds like the other party is trying to tell their insurance that its your fault, since you don't have insurance they may be looking at you as an easy target with no defense. get a lawyer and he will get them off your back.
