You cannot do that. You can give him to his father and it sounds like he will be better off with his dad.

Why do some people think children can be just tossed out???? You don't have the money to take care of the child? TOO BAD--get another job---I had 3 jobs while raising my kid alone.... I went without so that my child wouldn't have to suffer---THAT is what a mother does. If you are ILL and unable to take care of the child, that's different but, whether you have custody of your son right now or NOT, if something happens to you that you can no longer take care of the child, the court will automatically award custody to the father UNLESS the father has already been judged to be UNFIT or if a BLOOD RELATIVE of yours (like the child's GRANDPARENTS) feel that your ex would not be a good father then THEY can fight for custody of your son... but unless your husband gives up his parental rights, then you can't just GIVE your child away---and if you aren't SICK ON YOUR DEATH BED, there is NO EXCUSE for getting RID of your CHILD ---NO EXCUSE!!!!

If the father won't give up his rights, then you cannot "give away" your rights either. Custody of children is a joint thing, like a marriage -- it takes two people to cooperate to make it work.
Why on earth would you want to "give" your son away to your best friend anyway? Perhaps you should seek some counseling or other professional help to deal with these thoughts of abandonment before you make a terrible mistake that will affect the rest of your life.

Why not give custody to his father?? If you don't want to care for your son anymore then he would be the person to go to. Besides... boys need their dads.

the only possible way to give custody of your child is to either get him to agree...or fight for full custody...then sign your rights over..but you definately should make sure this is what you want because it may be harder for you to get custody back in the future...Good Luck
