Unless the person to whom the check is written endorses it to you, you can't legally do anything with the check. If they write "Pay to the order of (your name)" above their signature on the back of the check, you can then deposit or cash the check as if it was made out to you. If it was originally made payable to a business, most banks will only allow it to be deposited into an account owned by the business.
