Yes and a good way to get a baton shoved somewhere you don't want it. You can call them just about anything as long as you say "In my opinion ____________________ Sir/Maam/Madam" but then they normally find another reason to arrest you

not sure what the question means exactly, but in texas it is legal to use civil litigation as a threat. it's in the statute, check it out.
