Ok, I revised the letter I had posted earlier...Thank you to all of you who gave your opinions!! I think I used a little of all of your answers in this letter!!

Dear Mrs. Williams,

I regret to inform you that I am no longer in a position to rent your building. Due to a change in partnership, I am unable to manage being the sole renter.

I will have the building cleaned and vacated by June 16, 2007. At that time, I will also mail you all of the keys. Please consider reimbursing my deposit. You may send it to me at P.O. Box 853, Center, TX 75935.

Thank you for allowing me to rent the building from you, I greatly appreciate it.

Ok, does this letter sound better? Or do you think I should change some of the wording again?? This is only a month to month rental so I dont have a contract or anything. Thanks for all your help!!

As far as grammar goes--
"Thank you for allowing me to rent the building from you. I greatly appreciate it"

Two sentences.

As a letter to your landlord, you must give 30 days notice. Probably you will be reponsible for July's rent as well.

I would send it certified mail so that you have proof that it was delivered. That is a much better idea than just mailing it b/c then you never know if the letter/keys were lost in the mail.

It's a good letter, but you really don't have to tell your landlord why you won't be renting any longer. Do you pay your rent from the 1st of the month to the last day of the month or from the 15th to the 15th? Are you paying rent for the full month of June? If you pay rent to the 15th, this is fine, but otherwise you might want to be more clear. And perhaps you could be a bit more assertive about the return of the deposit. This sounds like you aren't sure if you should get the money back, but you hope they'll decide to send it to you. If there is no damage done and the building is clean, then legally you have every right to expect your deposit back. And finally, if your partner was originally a renter, then he/she is still responsible for the state of the building and the cheque refunding your deposit may very well be made payable to both of you. The wording in your letter seems to absolve the other partner from any responsibility and accept it all yourself, which might not be a good idea if your landlord decides you've done some damage and presents you with a bill.

"Please accept this letter as notice that we will no longer be renting your building. We will vacate the premises no later than June 16 and will return all keys by mail on that date. Our security deposit can be mailed to us at the following address..."

It sounds good to me. My daughter is an assistant manager at an apartment complex & she said that as long as you give them notice they are supposed to refund your deposit but not until they receive the keys. They don't have to refund you til they have the keys in hand. They can charge you for the days they are in the mail. You really need to do it in person so you can do a walk-thru with them. Have a witness with you. Is there a specification in your contract that states how much of a notice you have to give to vacate to receive your deposit in full? If there is & you vacate before that time frame is up, they can charge you for the remaining time. Yes, you do have to give a reason in your notice to vacate. Make a copy of the letter for yourself & have the landlord sign both.
