My son lives in Tennessee, his mother has custody, but he wants to live with me. His mother is very uncooportive, does anyone know what age he can choose what parent he wants to live with?

The answer is 18 (the age of majority). Until a child becomes an adult they may not decide on their own which parent to live with after divorce. In Tennessee, if a child is 12 years of age or older the judge must hear testimony from the child (either in court or in chambers) as to the preference of the child. However the judge is under no obligation to place the child in their preferred home. The preference of the child is merely one factor that the judge will consider in awarding custody to the primary residential parent. The main consideration that the judge uses to determine custody is the best interest of the child. The preference of the child is only one consideration in determining what is in the best interest of the child.

It depends on the state you live in but the rule of thumb seems to be age 14 but that is dependant upon the circumstances surrounding the decision and the maturity of the minor child. In other words the answer is 14 but a determination must be made as to the best interests so the why is important also

In most states the child can at 12 years of age let the judge know where he/she wants to live. The decision is still up to the judge but the request of a child this age or older is taken into consideration.

At the age of 16 you can get legal rights to be your own guardian and get rid of ur mother, for good, but that's a really permanate solution, you could just talk w/ ur mom, and if your mom disagrees, have your dad talk to her, but legally i think it's 16, plus then if you have a car just go for it and drive... i'm 14 and i choose where I live cuz I am a very defiant person, you can just do what you want, and leave but that can cause some problems but i think legally ifyou go to court it's 12 or 13

It depends on the state law where the child lives. Most courts will hear teenagers' requests. Get ready to go to court with his mom to fight for custody. Most women will never voluntarily give up custody of their child even if it is in the best interest of the child and that is what he wants.

Well I don't know where your from. I think some laws are different. But I live in Canada and I am pretty sure the age is 14yrs. Hope this helps.

Cheek the state she lives in 12 or 13 comes to mind as an average.

DEPENDING ON HIS AGE NOW. I KNOW THAT IN AZ THE CHILD NEEDS TO BE AT LEAST 12-13YRS SO YOU MIGHT WANT TO CHECK WITH AN ATTORNEY

Most States are different about this rule...you can call your state attorney's office and they will be answer it correctly and accurately for free.
