If you both are still on friendly terms and both agree on the divorce, hire a much cheaper but just as good Paralegal and sit down and work out all the details. The Paralegal will put your ansers on paper and at the end all will sign the papers and get them notorized and then file them with the divorce court. The Judges love this way and are more willing to grant the divorce without delay. Once in court the Judge will ask a few questions and then grant the divorce. The Paralegal usually knowsthe divorce laws and guidelines of your state too so its so much easier on all involved. Check your yellow pages for Paralegals

There are divorce kits. The local library should have do=it=yourself divorce, including all the forms. Sort out the things you do agree on, and run it by a lawyer together.
There may be some things changed, as a lawyer can suggest things which appeal to one or both of you, instead of your original plans. Get it worked out the best you can, and consult a lawyer before putting it before the courts.

When we got divorced we didn't use an attorney - we had everything laid out. We only went to the attorney to file the actual paperwork. One filed the petition the other responded then we filed a marriage settlement agreement - which the attorney looked over. We paid the attorney $500 plus filing fees. We had kids and a house. There was no fighting over anything. The kids were the priority not our own egos - it wasn't about who was right or wrong. It was how do we do this without causing any more heart ache for either of us or the kids....

PLEASE PLEASE PLEASE!
Get a lawyer...a real one. These issues can be very complicated even in the best of situations.
A divorce is a contract. A contract by which you will have to abide by until your children grown. You have to make sure it is right and exactly the way it needs to be to protect all of those involved.
Things sound amicable now. But you do not know what the future holds. A divorce agreement will give you whatever security you need for the future.
Also...document everything. And I do mean everything.

Start by asking friends if they know any good divorce lawyers and by calling attorneys in your area. Do you plan on keeping the kids, if so you should keep the house.

Usually you will have to sell the house to get your name off, or he can buy you out for half? They have divorce kits, and if you already have your agreements and there won't be fighting, then you can do it all yourself. You will have to have file your custody and maintenance agreement with the court before you file for divorce, too. Or there is always legal aid. Good luck
