The Constitution enshrined slavery. Remember the 3/5ths compromise? Is that saying all men are created equal? No.

The question of slavery was much on the minds of the authors of the Constitution, and a compromise was needed to get it adopted. No restrictions were to be put on slavery before 1808. Of course, after the Civil War, the 13th Amendment outlawed it altogether.

Alexander Hamilton was violently opposed to slavery. Most of the others did not consider black people as people. Obviously the 9 fat old white men on the Supreme Court agreed that they were not people. Much the say way as women were considered property and not people.
Bush's court is making some decisions that are just as atrocious as the Dred Scott Decision and many others back then. We overcame that. One day we will overcome Bush and his court.
